We collect and use personal information about you.
We collect, receive, and develop several different types of personal information about you depending on the nature of your interactions with us:
Contact Information: We may collect your name, email address, social media handles, mailing address, zip code, and phone number. If you create an account, we also collect your username and password. We also collect identifiers that you post to our sites, like photos or video.
Purchase and Preference Information: We may collect your order history, such as what products you have purchased or browsed through our website. We may also collect your product, shopping, and flavor preferences.
Internet and Network Activity Information: We may collect your IP address when you visit our sites. We also use tracking tools like cookies and pixels to automatically collect information about how you interact with our websites and online content. Location Information: We may automatically collect information about your precise geolocation when you access the mobile version of our website using GPS and WiFi technology. We also collect information about your general location using your IP address and your zip code if you search online for product retailers near you.
Demographic Information: We may collect demographic information, such as your age, date of birth or gender. We might also collect information about the age ranges of others in your household.
Employment-Related Information: We collect information about your work experience and previous employment, your education history, your resume, the URL to your personal or professional websites, your workplace skill sets and certifications, whether you need a visa to work in the United States, and salary expectations. If you apply for a job, you can choose to also voluntarily provide any of the following information: ethnicity, gender, disability status, and/or veteran status.
Payment Information: We collect billing information, such as your credit card number, expiration date, card verification number, and billing address if you make a purchase on our websites.
We collect and develop Inferences. Using the other pieces of personal information collected about you, we draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.
We use personal information for the purposes described below.
We use information for marketing purposes. For example, we use your information to tailor and send you information about new products and special offers. We also use information to tailor and serve you ads about products and offers. These might be offers from America’s Best Beverage or subsidiaries’ brands or products or services we think you would find interesting.

We use information to respond to your requests or questions. We use your information to respond to your questions, complaints, and feedback. If your request relates to products (e.g., complaints or returns) or transactions, we may also use your information to identify the particular transaction or product and make any payment adjustments. We also use your information to notify you if you win a sweepstakes or contest.
We use information to fulfill orders and communicate with you. We use your information to contact you about and fulfill your orders. We might also use your information to contact you about this Policy.

For example, we may collect information when you register an account, buy or return a product, sign up for an e-newsletter, enter a contest, submit or post content, or otherwise contact us. We work with business and marketing partners and social media platforms that give us information about you that they have collected either directly or indirectly from you. We may also receive information from a job network or social network if you choose to import your information from those platforms when applying for a job with us. We also use features that let your friends give us your information.

We combine information collected offline, such as information collected about you when you interact with our call center, with information collected online. We combine information that we have collected across other America’s Best Beverage and subsidiaries brand websites and outside party sites. We also combine information collected across devices, such as computers and mobile devices. These actions allow us to understand your consumer preferences more holistically. We also combine your information with other consumers’ information to understand preferences and trends within your peer group over time.
We share information with other parties.
We share information within America’s Best Beverage and its subsidiaries. We may share your information with our current Family of Brands. That list can be viewed here (https://www.americasbestbeverage.com/brands).
We share information with suppliers that perform services on our behalf for our own business and operational purposes. We may share information with suppliers that send emails for us, run our websites and contests, process payments, provide advertising or marketing services, track advertising impressions, provide analytics services, investigate and prevent data incidents, audit our business and financial statements, vet job applicants, provide legal advice, place our advertisements on other platforms, and fulfill and ship orders.
We may share your information with business partners and marketing companies. For example, we may share information with other parties that co-sponsor a promotion or sell our products. These partners may send you marketing information by mail or email. We may also share personal information with other parties, including those that run social media platforms, that help us with marketing. This may include social media platforms, advertising networks, and ad tech companies.
We will share information in order to comply with the law or to protect ourselves. For example, we will share information as required to respond to a court order or subpoena. We may share information if a government agency or investigatory body requests it. We might share information when we are investigating potential fraud, including fraud we think has happened during a contest or promotion. Or we may share your information if you are the winner of a contest or promotion with anyone who requests a winner’s list.
We may share information with any successor to all or part of our business. For example, if part of our business is sold, we may give our customer database to the buyer of the business as part of that transaction.

You have choices and rights regarding our use of your information.
You can opt-out of receiving our marketing emails. To stop receiving our promotional emails, follow the instructions in any promotional message you get from us. Some of our sites allow you to modify your preferences to opt-out. Even if you opt-out of getting marketing messages, we will still send you messages if you transact directly with us.
You can control tools on your mobile devices. For example, you can turn off the GPS locator on your phone.
YOUR CALIFORNIA PRIVACY RIGHTS. If you are a California resident, you can make the following requests with respect to your personal information:
- Access – You can request that we disclose to you the following: (i) the categories of personal information that we have collected about you; (ii) the categories of sources from which we have collected personal information about you; (iii) the business or commercial purpose for collecting or selling your personal information; (iv) the categories of personal information that we have sold about you and the categories of outside parties to whom the personal information was sold; (v) the categories of personal information that we have disclosed about you for our business purposes and the categories of vendors to whom the personal information was disclosed; and (vi) the specific pieces of personal information that we have collected about you over the past 12 months.
- Deletion – You can request that we delete the personal information that we maintain about you, subject to certain exceptions.
We will not discriminate against you because you exercised any of these rights.

We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests. Note that for purposes of these rights, personal information does not include information about job applicants, employees and other of our personnel or information about employees and other representatives of third-party entities we may interact with.
We will take reasonable steps to verify your identity prior to responding to your requests. The verification steps will vary depending on the sensitivity of the personal information and whether you have an account with us.
You may designate an authorized agent to make a request on your behalf. When submitting the request, please ensure the authorized agent is identified as an authorized agent.
We want our California residents to know the following:
- We collect and use the following categories of personal information as set forth in the California Consumer Privacy Act of 2018 for the business and commercial purposes described in this Privacy Notice: identifiers; payment and customer records information; characteristics of protected classifications under California or federal law (such as demographic information like gender and age); commercial information; internet or other electronic network activity information; geolocation data; audio, electronic or visual information; and inferences. We collect this Personal Information from the sources described above.
- We disclose each of the foregoing categories of personal information to our service providers and with suppliers, service providers, business and advertising partners, advertising networks, data analytics providers, and social networks for our business purposes to the extent permitted by applicable law.
- We may “sell” the following categories of personal information: identifiers; payment and customer records information; demographic information; commercial information; Internet or other electronic network activity; geolocation data; and inferences.
If you reside in California, you also have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. We do not knowingly collect personal information from children under 16.
